Hereinafter referred to as “the Company”, “we”, “us”, or “our”.

This website and online store are operated via Shopify.


2. Scope and Acceptance

These Terms of Service apply to all visitors, users, and customers of our website.

By accessing the website and/or placing an order, you agree to be bound by these Terms. If you do not agree, you may not use our Services.


3. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years old, or
  • You have permission from a legal guardian.

4. Products – Print-on-Demand Model

All products are made to order and produced only after purchase.

Because items are custom-manufactured:

  • Slight variations in color, print placement, or size may occur.
  • Colors may appear differently depending on screen settings.
  • Production begins shortly after order confirmation.

Once production has started, orders cannot be modified or cancelled.


5. Orders and Contract Formation

An order constitutes an offer to purchase.

A legally binding agreement is formed once:

  1. Payment has been successfully processed, and

  2. You receive an order confirmation email.

We reserve the right to refuse or cancel orders in cases of:

  • Payment authorization failure
  • Fraud suspicion
  • Pricing errors
  • Stock or production issues

If an order is cancelled after payment, a full refund will be issued.


6. Prices and Payment

  • All prices are displayed in EUR.
  • VAT is included where applicable.
  • Shipping costs are calculated at checkout.
  • Please note: orders shipped outside the EU may be subject to import taxes or customs fees upon arrival. These charges are the responsibility of the customer.

We reserve the right to modify prices at any time.

You confirm that you are authorized to use the selected payment method.

Ownership of goods remains with the Company until full payment has been received.


7. Shipping and Delivery

Delivery times are estimates only and are not guaranteed.

We are not liable for delays caused by:

  • Shipping carriers
  • Customs authorities
  • Production partners
  • Force majeure events

Risk transfers to the customer once the goods are handed to the shipping carrier.


8. Right of Withdrawal (EU Consumers)

Under EU law, consumers generally have a 14-day right of withdrawal.

However, pursuant to Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to:

Goods made to the consumer’s specifications or clearly personalized goods.

Since our products are made-to-order and printed specifically upon purchase, the statutory right of withdrawal does not apply.


9. Defective or Incorrect Items

If you receive:

  • A damaged item
  • A manufacturing defect
  • An incorrect item

You must notify us within 30 days of delivery by emailing:

Please include:

  • Your order number
  • Clear photos of the issue

Approved claims will result in a replacement or refund.


10. Intellectual Property

All website content, including but not limited to:

  • Logos
  • Designs
  • Artwork
  • Text
  • Images
  • Branding

is the exclusive property of The Birdwatcher’s Closet.

Unauthorized reproduction or commercial use is strictly prohibited.


11. Limitation of Liability

To the fullest extent permitted by law:

The Company shall not be liable for indirect, incidental, or consequential damages.

In all cases, liability is limited to the total amount paid by the customer for the relevant order.

Nothing in these Terms excludes liability where exclusion is prohibited by law.


12. Force Majeure

The Company shall not be liable for delays or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Strikes
  • Supply chain disruptions
  • IT system failures
  • Pandemic-related restrictions

13. Data Protection

Personal data is processed in accordance with our Privacy Policy.

Our store is hosted by Shopify, which processes certain data necessary to operate the platform.


14. Online Dispute Resolution (EU)

Consumers may submit complaints through the EU Online Dispute Resolution platform:

We are not obligated to participate in alternative dispute resolution but remain open to resolving disputes amicably.


15. Governing Law and Jurisdiction

These Terms are governed by Belgian law.

Any disputes shall be submitted to the competent courts of Belgium.


16. Amendments

We reserve the right to update these Terms at any time.

The updated version will be published on this page with a revised date.

Continued use of the website constitutes acceptance of the updated Terms.
